Terms of Service
These Terms of Service govern your use of Limbo Nodes game and server hosting services, Limbo Billing, the game server control panel, and related websites.
Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you and Limbo Nodes, operated by Tanner Swartz ("Limbo Nodes," "we," "us," or "our"), located at 527 Aqueduct Avenue, Martinsburg, WV 25404, United States.
By creating an account, placing an order, accessing Limbo Billing at limbo-nodes.com, using the game server control panel at panel.limbo-nodes.com, or using any hosted service provisioned through our platform, you agree to these Terms. If you do not agree, do not use our services.
These Terms apply to all orders, subscriptions, and services purchased through Limbo Billing unless a separate written agreement signed by Limbo Nodes expressly states otherwise for a specific customer or enterprise arrangement.
Eligibility and Service Area
Limbo Nodes provides game and server hosting to customers located in the United States only. By using our services, you represent that you are at least 16 years old, that you reside in the United States, and that all registration information you provide is accurate and complete.
We may refuse, suspend, or terminate service if we reasonably believe you do not meet these requirements, provided false registration information, or attempt to use our services from outside the United States. Using a VPN or proxy to circumvent geographic restrictions violates these Terms.
If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these Terms and that the organization meets the eligibility requirements above.
Services
Limbo Nodes provides game and server hosting and related infrastructure services. Orders are placed through Limbo Billing at limbo-nodes.com. Provisioned servers and game instances are managed through our game server control panel.
Service specifications, resource limits, locations, included features, and subdomain availability depend on the plan you purchase. We may modify, replace, or discontinue features where necessary for security, legal compliance, or operational reasons, provided the change does not materially remove a core paid feature without reasonable notice.
Where included with your plan, free subdomains under the limbo-nodes.com domain are assigned through Limbo Billing or the game panel Network tab. Limbo Nodes manages DNS records for those subdomains on our backend infrastructure. Customers do not receive access to external DNS administration tools as part of the service.
Account Responsibilities
You are responsible for:
- Maintaining accurate account and billing information in Limbo Billing
- Keeping login credentials and panel access secure, including enabling two-factor authentication where available
- All activity occurring under your account, whether authorized by you or not
- Content, software, mods, plugins, and data stored on or transmitted through your services
- Compliance with applicable federal, state, and local laws and these Terms
You may not share account credentials with unauthorized parties or allow others to use your account in a manner that violates these Terms. Each account is intended for use by the registered customer unless your plan expressly permits reselling or sub-licensing.
Notify us promptly at inari@limbo-nodes.com if you suspect unauthorized access to your account. We may require identity verification before restoring access or making account changes.
Acceptable Use Policy
You may not use Limbo Nodes services to:
- Violate any applicable federal, state, or local law, regulation, or third-party rights
- Distribute malware, conduct phishing, or engage in fraud, harassment, or abuse
- Send unsolicited bulk email (spam) or operate open proxies or relays without authorization
- Launch or facilitate denial-of-service attacks or other network abuse
- Mine cryptocurrency unless explicitly permitted by your plan
- Host content that is illegal in the United States, including child sexual abuse material
- Attempt to gain unauthorized access to our systems, other customers' services, or upstream providers
- Resell, sublicense, or share services in a manner not authorized by your plan
- Interfere with the proper operation of Limbo Billing, the game panel, or our network
- Consume resources beyond your plan limits in a way that degrades service for other customers
We may investigate suspected abuse and take action including warnings, rate limiting, service suspension, content removal, DNS or subdomain removal, strikes under our enforcement policy, or account termination.
You are responsible for configuring your server software securely and for moderating user-generated content on services you operate. Hosting third-party content does not shift legal responsibility away from the account holder.
Strike System and Enforcement
Limbo Nodes uses a strike-based enforcement system for most violations of these Terms and our Acceptable Use Policy. A strike is a formal notice recorded against your account for a confirmed policy violation. Strikes remain on your account record and may be considered in future enforcement decisions.
Accumulating three (3) strikes may result in permanent termination of your account and all associated services without refund. We may suspend services while investigating a reported violation and before issuing a strike where immediate action is needed to protect our network or other customers.
Severe violations may bypass the strike system and result in immediate suspension or permanent termination without prior warning. Examples include hosting illegal content, launching attacks against our infrastructure or third parties, repeated non-payment after suspension, or conduct that creates significant legal or security risk for Limbo Nodes or others.
We will generally notify you by email when a strike is issued and describe the violation and any required corrective action. You may respond through our support ticket system if you believe a strike was issued in error. Our determination after review is final for account enforcement purposes, subject to any non-waivable rights under applicable law.
Billing, Renewals, and Payment
Fees are billed in advance according to the billing cycle selected at checkout in Limbo Billing unless otherwise stated on your invoice. All prices are in United States dollars unless stated otherwise. Applicable sales or use taxes may be added where required by law.
By submitting payment, you authorize us and our payment processors (such as Stripe or other enabled gateways) to charge the payment method you provide for applicable fees, taxes, and renewals.
Recurring services renew automatically at the end of each billing term unless cancelled before the renewal date. Failure to pay may result in suspension or termination of services after reasonable notice where practicable.
Prices, promotions, and plan features may change for future billing periods. We will provide notice of material price changes when required by law or when reasonably practicable.
You agree that we may send billing notices, receipts, renewal reminders, and service-related communications electronically to the email address on your account.
Refunds and Cancellations
Unless required by applicable law or expressly stated on your order confirmation, all fees are non-refundable once a billing period has begun and services have been provisioned or made available.
You may cancel recurring services through Limbo Billing before the next renewal date to avoid future charges. Cancellation does not automatically entitle you to a refund for the current billing period.
When you cancel a game server service, we may attempt to create a final backup for download through Limbo Billing. Backup availability, retention period, and download access are not guaranteed and are described in our documentation and cancellation flow.
If we terminate your account for a material breach of these Terms, no refund will be issued for unused time. If we terminate service without cause, we may provide a prorated refund for unused prepaid service at our discretion.
Nothing in these Terms limits any non-waivable refund or cancellation rights you may have under applicable West Virginia or other United States consumer protection laws.
Backups and Data
You are responsible for maintaining backups of content and data you care about. Limbo Nodes may offer backup features through the game panel or at cancellation, but we do not guarantee that backups will be created, retained, or restorable in every circumstance.
Backup retention periods, storage limits, and restore availability depend on your plan and the tools we provide at the time of service. You should not treat platform backups as your sole copy of important data.
We are not liable for loss of data resulting from customer actions, software errors, hardware failure, maintenance, termination, account abandonment, or events outside our reasonable control.
Ownership and Content
You retain ownership of content, files, configurations, and data you upload or host on your services, subject to the licenses you grant in these Terms and any rights of third parties.
You represent that you have all necessary rights to host, store, and transmit your content through our services and that your content does not infringe any copyright, trademark, privacy, or other rights of any person or entity.
Limbo Nodes does not claim ownership of customer-hosted game worlds, mods, plugins, or player data. We may access, copy, or remove content as needed to provide support, respond to abuse reports, comply with law, enforce these Terms, or protect our infrastructure.
Server Limits
Unless expressly approved in writing by Limbo Nodes, each customer account may maintain a maximum of three (3) active server instances at any time. This limit applies across all active services under the account, regardless of game type or plan tier.
Attempting to exceed this limit by creating additional accounts, using alternate identities, or other circumvention methods violates these Terms and may result in suspension or termination of all related accounts.
If you need more than three active servers for legitimate use, contact us at inari@limbo-nodes.com before placing additional orders. We may approve higher limits at our discretion based on plan, payment history, and resource availability.
Suspension and Termination
We may suspend or terminate services immediately if you breach these Terms, accumulate three strikes under our enforcement policy, fail to pay amounts due, create legal or security risk for us or others, abuse network resources, or if required by law or an upstream provider.
During suspension, you may lose access to the game panel, Limbo Billing service management features, and hosted instances. We are not obligated to maintain data during an indefinite suspension period.
Upon termination, your right to use the services ends. We may delete customer data, server instances, subdomains, and backups after a reasonable retention period following termination, except where retention is required by law or for billing, fraud prevention, or dispute resolution.
You may terminate your account at any time by cancelling active services and closing your account through Limbo Billing or by contacting support. Termination for convenience does not entitle you to a refund except as stated in the Refunds section or required by law.
Intellectual Property
Limbo Nodes retains all rights in our websites, branding, Limbo Billing portal, game panel customizations, documentation, and underlying platform. These Terms do not grant you ownership of our intellectual property.
You retain ownership of content you upload or host, and you grant us a limited, non-exclusive license to host, transmit, back up, cache, and process that content solely to provide, secure, and maintain the services.
Game titles, trademarks, and related assets belong to their respective owners. Limbo Nodes is not affiliated with or endorsed by game publishers unless expressly stated. You are responsible for complying with any end-user license agreements or terms imposed by game publishers for software you run on our services.
Copyright and DMCA
Limbo Nodes respects intellectual property rights and responds to valid notices under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. Section 512, and applicable United States copyright law.
If you believe content hosted on our services infringes your copyright, send a DMCA takedown notice to our designated agent with the information required by 17 U.S.C. Section 512(c)(3), including identification of the copyrighted work, the infringing material and its location, your contact information, a statement of good faith belief, a statement under penalty of perjury that your notice is accurate, and your physical or electronic signature.
DMCA notices and counter-notices should be sent to inari@limbo-nodes.com with the subject line "DMCA Notice." We may remove or disable access to allegedly infringing material and may terminate repeat infringers in appropriate circumstances.
Submitting false or bad-faith DMCA claims may expose you to liability under federal law. If you receive a takedown notice affecting content you host, you may submit a counter-notification as permitted by the DMCA if you believe the removal was in error.
Inactive Account Abandonment
An account or server instance is considered inactive when there has been no meaningful customer activity for thirty (30) consecutive days. Meaningful activity includes logging into Limbo Billing or the game panel, submitting support tickets, making payments, or other documented use of provisioned services.
Before treating an account as abandoned, we may attempt to contact you using the email address on file. If the account remains inactive after notice or where notice is impracticable, we may suspend services, delete server instances, remove subdomains, and delete associated data without further obligation to retain or restore that data.
Abandonment does not relieve you of outstanding payment obligations incurred before the account became inactive. Prepaid service fees are generally non-refundable upon abandonment except where required by law.
Monitoring and Security
To operate, secure, and maintain our platform, we may monitor network traffic, resource usage, log data, and service activity for signs of abuse, fraud, Terms violations, and security incidents. Monitoring is limited to what is reasonably necessary for service delivery, abuse prevention, and legal compliance.
We do not routinely access the contents of your hosted files or game worlds except when needed for support at your request, to respond to abuse or legal process, to enforce these Terms, or to address a security incident affecting our infrastructure or other customers.
You are responsible for securing your server software, plugins, panel credentials, and any player data you collect. We implement reasonable platform-level security measures but cannot guarantee that your services will be free from unauthorized access or third-party attacks.
Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that services will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected. No advice or information obtained from Limbo Nodes or through the services creates any warranty not expressly stated in these Terms.
Some jurisdictions, including West Virginia to the extent applicable, do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIMBO NODES AND TANNER SWARTZ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED IN CONTRACT, TORT, STATUTE, OR ANY OTHER LEGAL THEORY.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO LIMBO NODES FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow certain limitations of liability, so these limits may not apply to you in full.
Indemnification
You agree to defend, indemnify, and hold harmless Limbo Nodes and Tanner Swartz from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the services, your content, your violation of these Terms, or your violation of any law or third-party rights.
This indemnification obligation includes claims arising from content you or your users host, DMCA or other intellectual property disputes related to your services, and regulatory or law enforcement actions connected to your account activity, except to the extent caused by our gross negligence or willful misconduct.
Service Level Agreement
Limbo Nodes does not provide a service level agreement ("SLA") for uptime, performance, or support response times unless expressly included in a separate written agreement signed by an authorized representative of Limbo Nodes.
Standard shared hosting plans are offered on a best-effort basis. Scheduled maintenance, emergency maintenance, hardware failure, network issues, distributed denial-of-service events, upstream provider outages, and factors outside our reasonable control may cause downtime without credit or compensation.
Any uptime guarantee, service credit program, or priority support commitment applies only to the specific customer and terms set out in that signed written agreement and does not extend to other customers or standard plans.
Third-Party Services and Software
Our services depend on third-party infrastructure, payment processors, game software, mods, plugins, and other tools not controlled by Limbo Nodes. We are not responsible for the availability, security, licensing terms, or conduct of third-party providers or software you choose to install.
Links to third-party websites or services from Limbo Billing or our documentation are provided for convenience. We do not endorse and are not responsible for third-party content, products, or privacy practices.
Your use of third-party software on your server may be subject to separate license agreements. You are responsible for ensuring that any software you install complies with its license and with these Terms.
Law Enforcement and Legal Requests
We may disclose account information, service records, and hosted content when we believe in good faith that disclosure is required by applicable law, regulation, legal process, or governmental request, or when necessary to protect the rights, property, or safety of Limbo Nodes, our customers, or the public.
When permitted by law, we may notify affected customers of legal requests for their data before disclosure. We may withhold notice where prohibited by court order, where notification would create risk of harm, or where delay is necessary to preserve evidence in an active investigation.
Law enforcement and legal process requests should be directed to inari@limbo-nodes.com. We require valid legal process before disclosing customer content except in emergencies involving imminent danger of death or serious physical injury.
Force Majeure
Limbo Nodes is not liable for any failure or delay in performing our obligations under these Terms where the failure or delay results from events beyond our reasonable control, including natural disasters, acts of war or terrorism, civil unrest, labor disputes, government actions, power or telecommunications failures, upstream provider outages, or widespread internet disruptions.
During a force majeure event, our obligations are suspended for the duration of the event. We will use commercially reasonable efforts to restore services and communicate with affected customers when practicable.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of West Virginia, United States, without regard to conflict-of-law principles, and applicable United States federal law.
Any dispute arising from these Terms or the services will be brought in the state or federal courts located in Berkeley County, West Virginia, and you consent to their personal jurisdiction and venue, except where applicable law requires a different forum or non-waivable consumer rights apply.
Before filing a claim, you agree to contact us at inari@limbo-nodes.com and attempt to resolve the dispute informally. West Virginia residents may also contact the West Virginia Attorney General's Consumer Protection Division regarding certain consumer complaints.
General Provisions and Contact
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice through Limbo Billing or by email. Continued use of the services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the services and cancel active services before the effective date.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of that provision. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
These Terms, together with our Privacy Policy and any order-specific terms presented at checkout, constitute the entire agreement between you and Limbo Nodes regarding the services.
